A European Arrest Warrant (EAW) is valid throughout all member states of the European Union (EU). Once issued, it requires another member state to arrest and transfer a criminal suspect or sentenced person to the issuing state so that the person can be put on trial or complete a detention period.

An EAW can only be issued:
For the purposes of conducting a criminal prosecution or enforcing a custodial sentence not for conducting a criminal investigation;
- A warrant can only be issued for offences carrying a maximum penalty of 12 months or more in prison. Where sentence has already been passed the warrant can only be issued if the prison term to be enforced is at least four months long.
Extradition – Non EU Countries
The law on whether you can be extradited from a Non EU country depends on the country in question. If the country is part of the Commonwealth, or has a ‘treaty’ with the UK, which is an agreement between the countries different rules may apply, the country in question will make an application for extradition of the individual to the UK who will consider the case to extradite the person.
